Castle Pines Insurance Brokers assists individuals, families, property owners and businesses with personal, residential, commercial and specialty insurance needs. We are an insurance agency, not an insurance company, and we do not underwrite or issue insurance policies.

Depending on the insurance requested, carrier availability, geographic location, licensing requirements, market access and the complexity of the risk, assistance may be provided directly by Castle Pines Insurance Brokers or through a licensed insurance producer, broker, agency or specialty insurance partner selected to assist with the request. These professionals are referred to in these Terms as “Referral Agents.”

A Referral Agent may be independently owned and operated and may not be an employee, subsidiary or legal representative of Castle Pines Insurance Brokers. The licensed professional or agency handling an insurance request is responsible for the insurance advice, quotations, applications, recommendations and policy services it provides.

Insurance Requests and Referral Agents

When you submit an insurance request, Castle Pines Insurance Brokers may review the information to determine whether the request can be handled directly or should be referred to a Referral Agent with appropriate licensing, experience, carrier relationships or specialty-market access.

By submitting a request, you authorize Castle Pines Insurance Brokers to share information reasonably necessary to evaluate and service that request with a selected Referral Agent and appropriate insurance-market participants, which may include:

• Licensed insurance producers, brokers and agencies.
• Insurance carriers and their authorized representatives.
• Specialty insurance partners.
• Wholesale insurance brokers.
• Managing general agencies or managing general underwriters.
• Program administrators.
• Surplus-lines brokers.
• Service providers that support insurance applications, document processing and communications.

Castle Pines Insurance Brokers generally seeks to share a request only with selected professionals reasonably believed to be capable of assisting with the stated insurance need. If the initially selected professional cannot assist, the request may be referred to another appropriately licensed Referral Agent in accordance with the consent provided and our Privacy Policy.

You are not required to purchase insurance from Castle Pines Insurance Brokers or from a Referral Agent. You remain free to seek assistance from another insurance professional.

Role of Referral Agents

A Referral Agent may communicate with you directly, request additional information, evaluate your insurance needs, obtain quotations, recommend coverage and assist with an insurance application.

Referral Agents are responsible for their own licensing, regulatory compliance, recommendations, representations, carrier relationships and insurance services.

Castle Pines Insurance Brokers does not control an independent Referral Agent’s underwriting submissions, carrier selection, coverage recommendations, pricing, business practices or policy services.

Nothing in these Terms limits any responsibility Castle Pines Insurance Brokers or a Referral Agent may have under applicable insurance law.

No Insurance Coverage Is Created Through the Website

Submitting an insurance request, uploading an existing policy, communicating with a representative, receiving an estimate or receiving an email or text message does not create, bind, renew, extend, modify or replace insurance coverage.

Insurance coverage becomes effective only after all applicable requirements have been completed and an insurance carrier or appropriately authorized licensed insurance professional has expressly confirmed that coverage is bound.

No Website content, form submission, intake summary, preliminary estimate or communication constitutes:

• An insurance policy or binder.
• A declaration page or endorsement.
• A certificate of insurance.
• A renewal confirmation.
• A guarantee that insurance is available.
• Evidence that an insurance carrier has accepted a risk.

Insurance eligibility, pricing, policy terms and underwriting decisions are determined by the applicable insurance carrier. These decisions may depend on property characteristics, location, occupancy, claims history, driving history, insurance history, business operations, requested coverage, credit-based insurance information where permitted by law and other underwriting factors.

Quotes, Estimates and Pricing Information

Any premium estimate, minimum premium, average cost, cost range or coverage illustration appearing on the Website or provided during an initial communication is for general informational purposes only.

An estimate is not a formal insurance quotation, offer of insurance or guarantee of pricing. Actual premiums may be higher or lower based on underwriting, carrier eligibility, selected limits, deductibles, endorsements, inspections, taxes, fees and other rating considerations.

A reference to an insurance carrier or product does not necessarily mean Castle Pines Insurance Brokers has a direct appointment, contract or binding authority with that organization. Surplus-Lines Insurance

Certain specialized, difficult-to-place or higher-risk insurance requests may be considered for placement in the surplus-lines market.

Surplus-lines insurance may be issued by an eligible nonadmitted insurer that is not licensed in Colorado in the same manner as an admitted insurer. Such coverage may not receive protection under the Colorado Insurance Guaranty Association Act.

Information About Other People

If you submit information concerning another person, household member, driver, employee, business owner or other individual, you represent that you have lawful authority or appropriate permission to provide that information for insurance purposes.

If you upload an insurance policy, declaration page, identification record, driver information, loss history, business document or other file, you represent that:

• You are authorized to possess and share it.
• It relates to a legitimate insurance request.
• It has not been unlawfully altered or fabricated.
• Its submission does not violate another person’s legal or privacy rights.

Automated Systems and Artificial Intelligence

Castle Pines Insurance Brokers may use automated telephone systems, artificial intelligence, chat tools, transcription services, form-processing systems and similar technology to answer inquiries, collect factual information, organize requests and support administrative communications.

An automated system is not an insurance carrier, underwriter or substitute for an appropriately licensed insurance professional. Automated systems cannot bind coverage, approve an application, make a final underwriting decision or provide a definitive interpretation of an insurance policy.

Telephone, Email and Text Communications

Where disclosed in the consent presented when you submit the request, you also authorize the selected Referral Agent to contact you concerning that request.

Communications may occur by telephone, voicemail, email or text message. You represent that the contact information you provide belongs to you or that you are authorized to use it.

If you separately consent to receive text messages, messages may include responses to your inquiry, requests for additional information, quote updates, appointment reminders and insurance-related follow-up. Message frequency varies. Message and data rates may apply.

Consent to receive marketing text messages is not a condition of purchasing insurance.

You may revoke consent to receive text messages at any time by replying STOP or communicating your request through another reasonable method. You may reply HELP for assistance. Opt-out requests will be honored as required by applicable law.

After an opt-out request, we may send one confirmation message. Communications that are legally required or reasonably necessary to service an existing insurance policy may continue where permitted by law.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Castle Pines Insurance Brokers and its members, owners, employees, contractors and representatives from claims, losses, liabilities and reasonable expenses arising from:
